Oppo: Sonia Sotomayor blinded by ideology - Kenneth P. Vogel - POLITICO.com

Conservatives plan to cast Supreme Court nominee Sonia Sotomayor as a left-wing activist judge who is occasionally blinded by her own feelings and personal politics.

That's the portrait that emerges from the opposition research that began circulating in the moments after news broke Tuesday morning that President Barack Obama intended to nominate her for the seat made vacant by the retirement of Justice David Souter.

One memo, circulated by the Judicial Confirmation Network, a conservative group that aired ads attacking Obama during his presidential campaign, cites a 2002 California speech in which Sotomayor, a federal appeals court judge, asserted that it is appropriate for judges to consider their "experiences as women and people of color" — factors that "should affect our decisions," she said.

"I would hope that a wise Latina woman with the richness of her experience would more often than not reach a better conclusion than a white male who hasn't lived that life," she said in the same speech.


Will these arguments make a difference? I doubt it. But it can give Conservative Senate candidates an issue to run on in 2010.
